Undergoing a dissolution of Marriage is basically filing for divorce, although there are some differences. With dissolution, it must be a no-fault divorce where no blame is placed on either individual. This may not be an option for all couples but there are many that can appreciate this form of separating because it is often faster and cheaper than other forms of divorce proceedings.
Because there are fewer issues to be resolved, the matter can often be worked out between the couple or with a mediator. When a mediator is required it is known as a mediated divorce, but it will still prevent the need of the couple to go before a judge. It is something that should only be considered when communication and agreements over the division of property and child custody or child support issues are possible.
The majority of clients who choose this method will still need to have an attorney to handle all of the legal forms and filing of the paperwork. It is also a good idea to have someone with a legal background to consult with to ensure that all agreements protect the rights of everyone involved.
The only instances where an attorney may not be needed is when there are no minor children or shared property. In these cases, when everyone agrees, it is considered to be an uncontested or simplified divorce. This is not the same as when one member of the couple has filed for divorce, but the other is unable to be located or refuses to respond. This requires an appearance by the filer in front of a judge where a default divorce will be performed.
A dissolution of marriage, regardless which category listed above that it may fall under, is not the same as an annulment. When a marriage is annulled it is legally considered to have never happened. The individuals are considered single once the paperwork has been filed as opposed to divorced.
