In the event of a divorce or legal separation and there are children involved, the children will go with one parent known as the custodial parent. The other parent assumes a financial obligation to provide the custodial parent with funds for child support in Boise Idaho. There are no fixed rules and every situation is a little different than others but generally speaking child support in Boise Idaho is paid by the father who does not live with, nor provides custodial care of the minor children. There are many instances where the children live with their father after the divorce and the mother may be the one who pays child support as she does not have custody of the children. In rare cases, the children may not be in the legal custody of either parent and in this case, both parents will be obliged to pay child support to the third party.

The custodial parent or the primary care giver is given financial compensation which is for the care and the general welfare of the child or children. This money is designed to provide the necessary funding to meet the costs of raising the children, these costs include food, clothing, education, health care and other incidental expenses that the children may have such as entertainment. Child support is usually court ordered but in some cases the couple works out a support program between themselves.

Although there will be a custodial parent or a third party that assumes the responsibility for raising the children, there are courts that believe both biological parents should share in the provision of monetary support for their children’s needs. The amount of money that each biological parent is expected to pay is based on one of two principals, both of which are based on a percentage; the actual cost of raising a child or the gross income of the parent who does not have custody. The rules for child support in Boise Idaho may be different than in other jurisdictions.

Child support usually continues until the child has reached the age of 21. There are certain laws and agreements made that may either extend this age or decrease it. A typical example would be that an agreement was made at the time of the divorce that the non custodial parent would continue making child support payments until such time as the child graduated university.

Child support in Boise Idaho will be the responsibility of the non custodial parent in a divorce. For information you are invited to address your questions to Finch-O’Neil Law Office.
